Compensation
 

In case of unnatural death (Traffic accident) the legal heirs of the deceased are entitled to get compensation according to Sharaih Law. To collect compensation, one can either authorize his friend/relative staying in KSA or may authorize HE, the Consul General, Bangladesh Consulate, Jeddah. In order to make such authorization, the legal heirs should prepare a Power of Attorney. This attorney must be attested by the Ministry of Foreign Affairs, Bangladesh and Embassy of KSA in Dhaka, Bangladesh. The attorney must contain a succession certificate, guardianship certificate of minor children (less than 15 years old) from next of kin issued by the Court. All of the papers must be translated into Arabic.

The deceased family may send the Power of Attorney through Bureau of Manpower & Employment Training (BMET), 89/2, Kakrail, Dhaka-1000. Necessary contact number: Director (Welfare): 00-880-2-9361820, 01819-249781.


If any worker dies while working due to the fault of any machinery, equipment etc. then the sponsor of the deceased will pay work accident compensation claim. If the deceased has an insurance with any Insurance Company, the concerned Company will communicate directly to the legal heirs regarding the settlement.

If any worker dies due to a traffic accident or is murdered the accused has to pay death compensation as blood money according to Shariah Law. Police authorities after investigation will fix the percentage of responsibility and the compensation amount may differ accordingly. The death compensation claims are to be submitted to Shariah Court and the Judge (Kazi) decides the amount.

After hearing all sides, Shariah Court delivers its verdict. On submission of  verdict copy, Saudi Treasury (Baitul Mal) releases compensation amount. After hearing all sides, Shariah Court delivers most of the cases are being settled by Shariah Court within a period of One year. However, in some cases it takes a few years due to some technicalities/legal hurdles in the proceedings.

All compensation claimants should invariably submit (i) Legal Heirship Certificate and (ii) Power of Attorney (POA) to the Shariah Court. Legal Heirship Certificate is being issued by Court of law and Power of Attorney is to be executed by all the legal heirs of the deceased with Judicial authorities (Notary Public) in Bangladesh.  Legal Heirship Certificate and  Power of Attorney must be translated into Arabic.

English and Arabic versions of both the Succession Certificate and  Power of Attorney (POA) are to be attested by Ministry of Foreign Affairs, Dhaka and Saudi Embassy, Dhaka. These are to be further attested by Saudi Ministry of Foreign Affairs and Ministry of Justice at KSA and submitted to the concerned Shariah Court for settlement of death compensation.
